The punishments facing people charged with drinking and driving in New Jersey are not light. Drivers face the loss of their license, the impounding of their vehicle, stiff monetary fines and having their driving record tarnished for life. Because the penalties and the charge of a DUI are so serious, the state of New Jersey must prove several important things before issuing a punishment for any suspect driver.

New Jersey DWI punishments are handed down after a successful prosecution by the state. The state generally follows two methods of seeking a successful conviction. They either must prove that the suspect was impaired in their ability to drive or must prove that the suspect had a blood alcohol level of more than 0.08% if they were 21 years old or more. It can be difficult for the state to prove these elements but if they do then several punishments face the defendant.

A New Jersey law known as "John's Law" makes it possible for the police to impound the vehicle of a drunk driver. Each vehicle can be impounded for up to 12 hours after police suspect drinking and driving and make an arrest. If a DWI suspect refuses a blood or breath test they can also be held for further damages and charged with other violations and fined. DUI's in school zones carry their own unique sets of charges and will result in greater fines and penalties as well.

A first offense for a DWI in New Jersey carries with it a fine of up to $400, a $30 court fee, $50 to be paid to a Violent Crimes Compensation Board, $75 paid to a Neighborhood Fund Assessment, a $200 DWI fund fee, up to 48 hours of courses at the Intoxicated Driver's Resource Center, up to 30 days in jail, a Restoration Fee of $100, an MVC charge of $3000, insurance penalties for three years and the possibility of a mandatory ignition device placed on your vehicle. First offenders of drinking and driving laws in New Jersey also lose their driving privileges for up to twelve months.
